usually data would be populated for those days later. sometimes no perm data for few days (you may find it before jan-2015). even dolstats tweeted mentioning "look like dol processing only h1b no perm today"

I have seen so many times more than 3 (one time 5) consecutive days with any approvals. Most of the item, it is website issue or processing on H1-B cases.

Just to confirm, Assume that a person X has filed in EB3 with the PD of Jan-2008 and the PD becomes current in Jan-2015. Till that, they will not withdraw his 140?

Did you get this details from any person from C*S - GIT? or it is based on your case? did this happen to anybody else?

Also regarding FOIA, did you receive approval copy or application petition copy?

Hi maverickwild,

Though C*S withdraws I-140, they don't do it for everyone who quit the company. I checked with a person who quit and joined the company after a year. He mentioned that his 140 was not withdrawn from C*S. At the same time, 140 has been withdrawn for one of my friend's friend, he worked for C*S for more than 8 years at onsite. Since he depends on 140 only and his new employer did not initiate his GC for some reason, he could not extend his H1-B and left to india.

140 is withdrawn only based on some creteria. Is that based on salary (i.e withdrawing 140 for people who are getting higher salary, as 140 is tied to prevailing wage and withdrawing that 140 can be used for others.)? or they might be doing (on purpose) for persons who reached maxout and depending only on 140?

is there any way to request not to withdraw before we quit?

it would be great help if you could share your thoughts.

Also did anyone receive 140 approval copy through FOIA. I heard through FOIA we can get only 140 application with the approval stamp on it. Is that enough for H1-B transfer and porting?

what about applying GC through consultancy without joining with them till we get GC? Once we get GC, we can join and work them for six months. i think, if we pay all GC amount from our hand, some consultancies would agree. it has less risk. but i heard, USCIS can revoke already granted GC, if they find the consultancy is doing something wrong. is that true?

anyone have more knowledge on this (GC for future based employement through consultancy)?

Current situation of Cognizant looks like CTS had created some issues in year 2011 in GC processing. So DOL broght CTS under "supervised recruitment" (Supervised recruitment is penalty imposed on employers. So DOL controls GC process in CTS like advertisement, instructing when to file.... In the past, CTS decides when to file, but now everything under control of DOL. That is the reason, CTS is not able to file GC for anyone having max-out situation as promised before recruiting them.). This has also been confirmed by our GIT person (refer the page 79 of this forum where there is a chat transcript of one of our associate with GIT person).

My question is why there are so many denials even when DOL imposed SR on cognizant. When Supervised recruitment will be taken away from CTS (so that they can file as in the past like other employers)

All of these are just my assumptions based on the information provided here. This may not be correct. There could be something else playing within CTS.

Still I've not met the maxout of my H1-B.

Just to confirm that you are in USA now and your last H1-B extension was based on your 140 approval. You requested your 140 appoval copy telling that you go to india for stamping. Am I correct?

Becoz CTS provides only based on the above scenario.

One of my friend got 140 Approval copy while going to india for stamping after max out of H1-B Visa. Is there any recent policy changes not to give 140 approval copy? Did you go for stamping after your Maxout (i.e current H1-B extension initiated based on your 140 approval)

Thanks hajisathik/spatil8148. I strongly doubt whether cognizant withdraws I-140 or not. If anybody knows cts ex-employee who quit after 140 approval, please share.

Also if I-140 has been revoked (not by fraud or misrepresentation), it will create some issues while porting. sometimes USCIS will port priority date, but sometimes not. I have seen in many forums where people are facing this issue. some of them fight with USCIS and get the porting done successfully. It is a game of luck. but to be on the safer side, we have to make sure what's cts policy and when it does.

regarding 140 approval copy, if we create foia request, we can get 140 application form with "approved" seal.
Please note this is not copy of approval notice (Form 797). CTS still give approval notice when you go for stamping to india.

does CTS withdraw I-140? may I know when it happens? when quitting the company they withdraw or based on some other situation?

Also even if you join to other employer after getting 3 year extension and start GC process, if CTS withdraws your I-140, there will be some issues while porting priority date with other employer at the time of I-140 stage. since I am also in the same stage, planning to quite after getting 3 year extn. but hearing from you that cts withdraw. Now bit worried on that.

Also if CTS withdraws, if there are any issue with other employer, we cann't jump to any other employer based on CTS's 140 as it is already withdrawn, so cann't get H1-B based on withdrawn 140.

It would be greate help if you please share some more details on this.

CTS upgrades EB-3 to EB-2, when you meet exiting CTS EB-2 eligibilities + some more elgibilities particular to upgrade. May I know when did you receive the information you received from HR persion. Is this recent decision by CTS not to upgrade from EB3 to EB2?
