Democrats/Liberals => Vote bank, showing themselves to the be the voice of the minority, making them self feel better
Republicans/Conservatives => midterm elections, Arizona and few key rep states they need to win
Biggest supporters for DACA => Everyone other than breitbart readers
Biggest opposers=> breitbart readers

H1B/EB's
Media => Punching bag, showcasing only the negatives
Democrats/Liberals => H1B/EB's ?? Who
Republicans/Conservatives => they want to fix legal immigration, but they don't want to loose a particular voting block
Biggest supporters for H1B/EB => does not exist
Biggest opposers=> fellow Indians (heard of big lobbying going on by Indian firms against h1b getting any benefits, they want to retain slaves) , EB1 abusers, Indians who feel entitled and praying other would fail, White, black, brown... may be even martians ...

So the chances of anything good coming out of these bills for eb i is zilch... our best bet was 140 EAD which was successfully lobbied away by the corporates...

Few Years back while i was trying to move to a different location post marriage... my friend had referred me to a big Bank FT in his company and i had applied for it... I had also uploaded my resume in some job portals as well... I had a good round of discussion and they had scheduled for a round two. Round two had a shocker, looks like they have the exact same profile from another desi consultant just the name, email and telephone etc were different. That guy had taken my profile and have submitted under one of his resource... This made me look in a bad light as the person interviewing was not sure who was faking the profile, later i asked them to call the consultant over the conference to sort it out... but eventually the position fell though because of all those confusion...

some of these desi consultants are criminals...

Its actually sad that no one really cares about employment based visa, off the million + GC each year they have a 140 K limit on employment based visa and off which we have a 7% cap => max a country like India or China will get is like 9800... i am not sure on the current backlog but without HR 392 or something like that... this backlog is never going to get cleared.. I am not talking about the living situation or the quality of life.. but the illegals get more support and sympathy from every corner... The projection is there are going to be a million new tech job in 2020 and they can churn out only 50K cs grads each year.. not sure how they are planning to bridge that gap... instead of wasting unused visa they could just remove the per country limit... and add the family in the open count than in employment count... once this is normalized.. they can may be add a country limit on h1b as well to control the in / out flow.

There is not discrimination. Only discrimination that exists is in your thought process. When anyone of you say that a person from other country gets residency well before you, first thing-
your totally negating the fact about how many people are applying from that country. Its obvious that the demand is tremendously high just from one country, and how did that happen? Thats by gaming the visa rules. So then why should any other country bear the pain of someone else's wrong doing?
Second thing-
all the countries are given equal % distribution of gc numbers every year. If the system was discriminating your country would have got less %? Is that the case? Infact your also negating the fact that your country is in fact receiving highest number of residency every year because of vertical and horizontal SPILL OVER. But some of you still cry in the name of discrimination even after receiving maximum number of green cards every year.
If spill over has dried, that too has been tracked back to the gaming of visa system done by your own people. So again why, why should other countries suffer because of your country's fraudulent activities?



If that is the case why not have 7% country restriction on h1b?? There is no restriction on the number of h1b but if the h1b files and intent to immigrate we have this 7% quota... The reason why people cry discrimination is because all of these companies claim to be be equal opportunity employers...

Well said. Most folks don't realize what the true meaning of alave is. Being a part if a country is learning its history as well. Nothing can ever be compared to "slavery". Period.

Its called evolution, this is the modern form of slavery.... only difference is the we have a choice to return back.... you are hear to work, but are owned by corporate... i am sure all so called wage problems would have evaporated ... had they given h1 EAD, but no... corps lobbied well to keep us under them.. as per the argument of finding innovators and trend settings.. Elon Musk did not have to wait 20 years to get greened... there are so many musk's rotting in the queue... I know positions open in rust belt area's for more than 6 months ... because they want to hire a citizen... the equal opportunities does not apply for h1b anymore as more and more organizations are not hiring h1b's anymore...

World has plenty of hardworking people. But in US, The concept of hard work applies only if skin in white.

If you are brown and you work hard, you are stealing jobs. If you are white and successful you are not stealing. Worse, If you are black you are just lazy. Thats the right wing idiots perception of the world. The vile breitbart and fox spreads, will make the world sick and barbaric. They would cast an immigrant as a criminal. Period. Even the Cali fire, you should read the article and comments. They celebrate because fire burns in Cali. Sick right wingers. Makes me wonder if there are right wing arsonists setting fire in California.

If you notice closely, centuries ago, When they landed in ships and forced themselves in and slaughtered native indians it was fine. When they landed in millions from Europe into Ellis island it was fine. Some how it is not fine now. (Only difference is skin and culture).

I have been in this country for 9 years now. I won't get my green card for next 15 to 20 years. I have advanced degree. I re skill myself constantly. I know I am living amongst racist govt. The good Americans are protecting us. The left.

If the entire world was left, world would be much better place.



H1B and Legal immigration is a political softball for both Left and right... Left would go all out in support for illegal immigrants... because they are a much bigger voting block and they would use legal immigration as bargain chips... the one thing both Left and right are against is employment based legal immigration. No one cares about the H2B visa increase because the pay is less and not much of a news value.. but with h1b... they can throw some fancy numbers saying all the good jobs are going away.... but no one cares about the fact all h1b are at the minimum bachelor degree holders... every one of them pay their taxes... contribute to the economy ... directly and indirectly.. Millions of jobs are lost to globalization and automation... somehow people expect to land an IT job straight from a manufacturing job.. without getting trained or gaining experience..

RFE is not the story, rather the demonization of employment based legal immigrants and non immigrant work visas... I guess it got to do with employment based legal immigrants not being a big enough voting block or may be they are just that they are soft target to win brownie point. These are hard working people paying their taxes and contributing to the economy.

contributing to the economy ?? they are bleeding the economy. It costs $500,000 to educate a PhD and when such a STEM PhD goes back due to H1B IT coolies, its a blow to the economy.

As per the new changes coming in for H1B a freshly minted MS/PHD will not qualify for H1B since all level 1 job are under scanner and those kind of foreign students are not required :). I thought some one was saying here that people with specialized knowledge are not required? what happened in this case :)

Weird status changes on USCIS - Vermont

Visa extension (Premium processing) got approved last Wednesday - with the status as expected "Case Was Approved And My Decision Was Emailed"

Today i am seeing - Case Was Approved
On December 1, 2017, we approved your Form I-129

Not sure why would someone approve a approved petition.. fingers cross hope nothing else changes now...

Anybody have a similar experience?

man any time I hear people posting how USA will loose tech leadership if H1Bs are kicked out, it makes me chuckle.

USA will do just fine. It will still be number one destination for most talented from all around the world (and their laws will continue to allow for that like EB1, Raise).

The only thing USA will loose is these "H1B IT coolies". You guys need some deep introspection if you don't agree (or need to update your skills). it's only time before the law catches up with you.

I was never an IT coolie. Came here for my PhD and since then, have been an academic and have a GC EB1B. But in grad school, I have seen how even Harvard or Columbia PhDs going back to India because of lack of H1Bs which were gobbled by desi slave traders.

There would be no tech drain. In fact abolishing low level H1Bs will be good for tech sector as foreign STEM grads can stay in the economy. An Indian BTech/BE holder has next to no knowledge of anything.

Look at Indian EB1C- they dont even know english.



If you already have an GC what are you doing in this forum... :O seriously PHD guy with a GC on Trackitt friday eve... my rational brain tells me u r bluffing but i will give u the benefit of the doubt... No legal immigrant is breaking the law... everything is done legally it is the law that needs to be updated.. no point spreading hatred about other hardworking folks.. Per the current law as much as you think a Harvard grad deserves a h1b... so does a person who is working in the industry.... like i said before its the loop holes in the law that needs to be fixed..

Citizens/permanent residents would do the job but at higher salary (100K vs 60K).

Kick out exploited H1B's and wages go up. Simple rule of supply and demand. Why it's so hard for folks around here to see that



Funny part is ... it is difficult for you to see it your self.. there is no blanket 100 K salary that citizen or perm get paid... Salary is mostly driven by the location, size of the company... and model of business... The problem is not H1B... but the loop holes which the companies exploit... FYI millions of jobs were lost to Automation and globalization which have nothing to do with h1b...

Just a request... uninformed comments like the ones you throw here are a major source for backlash against h1b and Indians in particular.....
