I got RFE on H4, it is minor they asked for passport photocopy.

I am also in the same boat.
received date showing 30th March and On April 19, 2017, they are showing Form I-129 received. I also got a letter that the case will be processed in premium but they refunded the premium processing fees.

thats what i understood from below statement

Provisions allowing certain nonimmigrant principal
beneficiaries, and their dependent spouses and children,
to apply for employment authorization if the
principal is a beneficiary of an approved EB–1, EB–2,
or EB–3 immigrant visa petition while waiting for his
or her immigrant visa to become available. Applicants
must demonstrate compelling circumstances justifying
an independent grant of employment authorization.

As per
• Allow certain high-skilled individuals in the United States with E-3, H-1B, H-1B1, L-1 or O-1 nonimmigrant status, including any applicable grace period, to apply for employment authorization for a limited period if:
1. They are the principal beneficiaries of an approved Form I-140 petition,
2. An immigrant visa is not authorized for issuance for their priority date, and
3. They can demonstrate compelling circumstances exist that justify DHS issuing an employment authorization document in its discretion.

Does that mean that if your I-140 has approved then you can apply for the EAD ?

Passport and stamped visa are enough. don't tell them the i-140 story. if they ask anything just reply in short. you tell more they will ask more so that's it.

My I -140 has approved a week ago, I haven't received any copy from USCIS.
I wan to apply EAD for my wife. Please suggest me shall i wait to get approval copy from USCIS or I can apply with their mail that my i-140 is approved.
