Topic: Dependent has to be in US for EAD/AP

It is advisable for the dependent to be in the country until the Advance parole is approved, if he/she leaves the country before approval then AP could be denied, have seen it approved in some cases and denied in my daughter's case, but she had a H4 visa so could re-enter. EAD will be approved though.

Same case here, my daughter's I131 was showing as "case approved" as of Nov 30, then it said "Case transferred to another office and new office has jurisdiction"

Topic: Case was transferred and a new office has jurisdiction I131

Originally my daughter's AP status was Case was approved and now it says the above, any one else in the same boat and what does this mean transferring a case after it was approved? The case was approved on Nov 28th and I see the above status today.

Any advice?

Correct me if I am wrong. I remember reading somewhere that NBC does the back ground check by coordinating with FBI and compiling results of BC. They prepare the file for interview before sending to field offices.

Even if you want to report, how will you provide the proof. There is no violation of the law per se, however there is gross misuse of the intent of the law. I guess there will be no more than a handful of truly international managers (Directors, Vice Presidents and above)in a company so TCS for example would file hundreds of such applications and get away with it. The word says international manager, so anyone with the designation of manager is eligible regardless of the how much he is paid. I have seen some international managers with less than 80K salary and if they apply for GC under EB1 they will get it within a year.
This is a real killer as there is no base salary such managers should be paid, unlike H1B where the prevailing wages have to be paid.

The system sucks but it is what it is.

What I understood from my attorney is that while I485 is pending you should have a valid status to return, if you have traveled abroad.

One Entering on AP Becomes a Parolee
It is a common misconception that entering the U.S. on a valid AP will not impact one’s H1B (or L-1) status. An individual with a pending I-485 application, who is eligible to enter in H1B (or L-1) status, may do so without abandoning the I-485 application. Using the AP to enter the U.S., however, terminates one’s nonimmigrant H1B (or L-1) status. The reason for this is that an entry on AP is not considered an admission in any particular status but, rather, it is a separate form of entry known as parole. Since the most important document evidencing one’s status in the U.S. is the I-94 form, one may easily determine the category of entry by looking at the I-94 issued at the port of entry. One who enters the U.S. on AP has a notation on the I-94 indicating that s/he is paroled into the U.S. An individual who uses a valid H1B (or L-1) visa to enter the U.S. is issued an I-94 specifying the appropriate nonimmigrant status and the date of expiration.

You are a genuine EB1C case and I don't foresee any delays or issues. You should get it soon. The EB1Cs under discussion here are mostly from services companies having some experience and low to mid range salary levels. Technically they don't qualify as International managers as they don't head divisions, Accounts or chief Architects or that sort. They maybe Tech leads or even managers but certainly don't meet the intent of the Visa class.

Topic: I131 denied and EAD approved on pending I485

My daughter is in the same boat, AP denied as she left before it was approved. She has a valid H4 though. I hope she will be able to reenter on H4. Did you face any issues coming back on H1/L1. The websites I checked mention there should be no issues coming back on valid H1/H4,L1/L2.
What is your experience.
