Interesting. Immigration departments within the IT companies and their attorneys/lawyers are the poorest of the employees from skill perspective - That is my experience. They do/say anything.
Another way is filing a FOIA with the receipt number. I have obtained my own information using it and so I know that it works, specially, if you request your own information from them.

Thanks for your response. 30 days seems long but could be real. Afterall, they suspended premium processing which is where they are also going to loose a lot of money. I also think that there must be some process to re request the documents in case one does not receive them in a time bound manner.

I see that USCIS is going to suspend premium process starting April 3rd. So starting April, the only type of cases being processed will be regular cases & no premium. What does this do to the speed of processing of regular cases? Does it really speed up the regular processing pace ? Another item to note is Begin April 3rd, CAP filings for year 2017 will begin so not sure if overall load of USCIS will reduce.

The date for H-1B (Specialty occupation - Extension of stay in the U.S.) now shows as -> October 2, 2016.

If you note, all service/processing centers are now saying the same date as of December 31 for all categories. not just, H1B :-
and that date is -> July 28, 2016.

This really looks odd but if it is correct then looks like a major movement of cases has happened among the service centers.

Topic: EAD for H4 Visa Holders

I have an approved I140, but
1. My H1B visa has not maxed out yet.
2. I have also never utilized the approved I140 for any of visa extensions.
In this case, can someone clarify if my spouse is still eligible to apply for EAD based on the approved I140 that I have ?

If my spouse is eligible for EAD then I assume submitting a copy of approved I140 would be sufficient along with rest of the required documents ?

I also did the same thing. Downloaded G-639. Filled all the relevant details. Signed it, scanned it and sent through email. Immediately received auto generated acknowledgement email as response. Now waiting.

Right now the form gives me a validation error - "AlienRegistrationNumber validation failed"

I also received I797 containing similar details. Wanted to understand what else is needed in order to be able to port dates using current approved I140 ?
Along with this, how much does retrieval of I140 records cost through a FOIA request ? If it is fairly nominal then I would like to go ahead and retrieve this anyway.

My PWD for PERM was filed on 9/17/2013 and response was received on 11/22/2013 which is 67 days. Note that the US government was shut from 09/30/2013 to 10/17/2013 (which is 18 days). So effectively they took around 49 days to process my PWD.
