Topic: Days since your RFER

Congratulations!!
USCIS works in mysterious ways. I replied to my RFE for just new medicals and it was received by USCIS on 12/20 and ever since the only status I see is that we have received your response to our RFE after 23 days.

I can only pray to God at this point.

Topic: Days since your RFER

Got an RFE for Expired Medicals + Gonnorhea Test Missing even though my medicals were still valid and the Gonnorhea test was not even a requirement when the doctor signed my medicals.

Paid another $1000 for redoing same medicals and now praying to God.

RFE Response was received by USCIS on 12/20/2017 however there is no update so far.

Should I wait some more before raising an SR? Would they even accept an SR at this stage?

Actually Yes!
I raised an SR on 16th Nov to which i got a standard response that we are still reviewing your case and give us 60 days but just about an hour back, I got RFE emails for both the primary and dependent so now I will have to wait for physical notices in the mail for what this RFE is about.

Next thing you can expect is an RFE. This is nothing but tactics to buy time by USCIS. They have wasted time and now they will buy more time by asking for evidence or medicals that they might already have.
I have exact similar response from USCIS on SR followed by RFE the very next day.

Same message for me as well and SR response is completely generic that we will get back in 60 days.

The status still shows "On February 22, 2017, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status"

Don't understand what is taking them so long. EAD/AP received on 10th April.

Can those of you who have gotten their i485 approved or interview scheduled or RFE issued, please update your profiles? This will help rest of us to see a trend as to what is going on with the TSC.

Thanks!!

For those who have gotten i-485 approved from Jan/Feb 2017 EB1C filing, did you have to go through an interview process?

I agree with gs321. It's total BS from the lawyer.
There is no perm process for EB1 then how is lawyer trying to port I-140 for EB3 that was based on a perm...

I guess he is just taking him for a ride

For those of you who have approved I-140 and were waiting for the dates to be current, did you get any communication from USCIS regarding interview or anything else now that the date is current?

Does i-485 processing happen sequentially once I-140 is approved??
Like for those of you who filed concurrently earlier this year say Jan, Feb, March would get processed earlier than whoever will be filing in Oct this year?

Yes, if the dates are current then you can file I485 anytime. Concurrent or later as long as the i485 filing dates are current.

My suggestion is that you should go ahead and file I485. What is the downside to it?
In the worst case scenario, should I-140 gets denied you would lose lawyer money but I'd say that is still better than some other executive order coming in while you wait to file I-485 and then you lose this chance.

With new administration and the way USCIS is delaying the EB1 process which used to complete in 4-6 months from concurrent filing to receiving GC in hand, my suggestion is that you should not wait and file your I-485.

Yes that's correct.

Even I am waiting from 2/17 and just now user zenoms confirmed that his RD was 1/30 and he got approval on 9/6 tells me that I have some more time to wait.

I don't understand why suddenly I-140 for only EB1C is taking this long while EB2 and other categories are getting approved quickly given that they are all on 1-April-2017 processing dates.

Agreed!! A lot of people don't update the status on Trackitt.

I can tell you my case should not fall in any category but straight but only if they picked up the file to begin with. Also like you mentioned, if they have any questions they can raise RFEs but they should keep the queue moving.

I guess USCIS behaves like a lottery system, if your stars are aligned you will get it if not you can spend your entire life waiting... there is no method behind their madness :-)
No sequential movement or respecting their own timelines.

At this point, I am just waiting to raise SR, though several people on the forum say that even on SR they just have automated responses and don't really do much.

**sigh**

yeah, I am surprised as well that TSC is sleeping on EB1 cases for more than 6 months but as far as you see on dashboard on trackitt there is only 10-20% approvals of cases from dec onwards under EB1C. only 2 cases are approved in Feb, 2 in march, 2 in april etc. Now I know that several people just don't update their case status on trackitt but still I am aware of atleast 2 guys in my company who are waiting from Dec and Jan filing.

USCIS processing is full of anomalies, they may approve someone from Aug 2017 while someone from Dec 2016 still shows as case received.

Don't know what to do.

My attorney says that SR can only be raised only after it is past processing date as per USCIS site and it still shows the processing dates for I-140 for EB1-3 as 2nd Feb 2017, so I will have to wait until that goes past 17th Feb which is my RD.

As for the approval timelines, I am also hoping that it should get approved anytime soon, though my attorney tells me that it's not unusual these days for I-140 to take upto 12 months to get approved specially for EB1-C. The other categories atleast have premium processing option we don't even have that.

Mine is concurrent filing at TSC and RD is 2/17/2017 and so far the status is 'Case Received'
Don't know how long will they take to process the I-140.
