Topic: Successful H1B/H4 stamping in Mumbai

We had a successful visa stamping in Mumbai in April last month.
The interview was easy and visa officer was pretty cool.

She asked questions like our favorite restaurants and locations in USA.
She was unfamiliar with my employer name so the only documents she asked was I-797, Passport, and LCA (to verify the employer name).
She then said our visa is approved.

Furthermore, we received our passports (H1B+H4) delivered to our hometown withing 2 business days.

Moreover, the immigration while travelling back to USA was easy too. The standard question was "my purpose of visit to USA".

Overall, it was a good experience with an immigration point of view. We didn't see anything odd.

Topic: Two DS-160 form submission

Hello,

Initially, I was planning to go for H1B stamping in Canada in March' 2017 and submitted a DS-160 form for Ottawa location. I haven't schedule an interview there though.
However, later on I finalized that to directly travel to India and get visa stamped in Mumbai. I have submitted new DS-160 for Mumbai location and have scheduled a visa interview next month in April' 2017.
I am curious to know that what will happen to my old DS-160 form which I submitted for Ottawa location but never scheduled an appointment there?
Will it impact my interview in Mumbai?
Should I keep confirmation page of old DS-160 (Ottawa) form while attending visa interview in Mumbai?
Is there any action needed to be taken from my side to cancel old DS-160 form?

Topic: Passport expiration and visa stamping

Hello everyone,

I just realized that my wife's passport is expiring on 11/29/2017. And, current H1B/H4 petition validity is until 01/30/2018.
We have stamping scheduled in India in April next month and DS-160 form is based on current passport number (expiration date 11/29/2017).

1) Do we have to renew the passport and carry that in visa interview?
2) Since DS-160 form in based on current passport, the new passport will be stamped with visa?
3) If consulate don't accept the new passport, my wife will get visa stamp end date as the passport expiry date 11/29/2017 or same as H1B/H4 petition end date 01/30/2018?

Please advice.

Thanks for sharing your experience here.
I have been researching about PIMS to figure out the whole process.
My H1B visa got approved on January 31st, 2017 and I'm going for stamping on April 15th.
I have heard about cases where PIMS is pending. Do you know about the days it takes to get PIMS updated after H1B petition gets approved by USCIS?
Does it get updated as part of a process or petitioner/employer has to explicitly request the update considering their employee's future travel?

Hello,

I had my last H1B visa stamped in Canada and my wife (on H4) had it done in India.
However, I have changed my employer recently in Jan 2017.
We are planning to travel India in April 2017.
I am not sure whether we both are eligible to dropbox facility.
Or if my wife is eligible as she had done previous stamping in India, she should accompany me during visa interview?

Just wanted to know if anyone is aware of PIMS database update timeline these days.
I am planning to get my visa stamped in April 2017 and have recently got transferred my visa to a new employer in January 31st, 2017.
Just curious to know if I can take some steps ahead of time to avoid delay during stamping process.

Whenever applying for H1B extensions, I used to pay premium processing fee and employer used to pay rest of the fees.

Just curious to know that if H1B extension gets denied and withdrawn, does USCIS return the money (H1B fees + Premium process fees) in one or the other case?

Topic: I-94 dates gap after recent H1B visa transfer

Hello,

I recently switched to a new employer and got H1B visa approved and I-94 start date both as 1/31/2017.
My previous H1B and I-94 end date was 9/30/2016.
However, my previous employer filed visa extension before I-94 expiration (9/30/2016) and that was still pending.
I got an offer and I transferred visa to new employer.

So, there in a GAP of 4 months between old and new I-94s.
Am I still eligible to stay in USA?
I knew if my visa transfer get approved on pending extension (previous I-94 expired) I have to go thru consular processing (in case I don't get new I-94). But, I got new I-94. Am I on eligible status?

I have to travel to India to attend wedding in my family in April. I recently switched to a new employer last month. So, I have to face visa stamping /interview while travelling. Based on current political scenario, I am a bit skeptical about successful visa stamping/interview in India. I heard news like drop box facility has been cancelled and everyone has to go for visa interviews. Also, there can be a delay in visa processing and receiving passport.*I have few below questions:

1) Will it be easier/smoother to travel to Canada and get my visa stamped there, just to avoid process delays and get stuck in India due to some unknown administrative reasons (4 months gap in I-94)?

2) I have successfully done my previous visa stamping in Canada in year 2013. Do you suggest visa stamping in Canada over India?

3) Will it be safe to travel to India during present political circumstances (H1B/H4 future possible orders) and face*POE questions?

below is my current status details:
1) EVC Model
2) Current H1B/H4 Visa valid until: 01/30/2018
3) New employment start date: 01/30/2017
4) Previous H1B/H4 Expired: 09/30/3016
5) Visa Extension filed by previous employer was in process and meanwhile I switched to new (current) employer on 01/30/2017. My previous employer has withdrawn the pending H1B/H4 application.
6) Previous I-94 expired: 09/30/2016
7) New I-94 start date: 01/31/2017 until 01/30/2018
8) Since, I switched employer (visa transferred) while H1B/H4 visa extension was pending, new I-94 start date is on which visa transferred got approved (01/31/2017). So, there is a GAP of 4 months.
9) I-140 approved by previous employer and wife has got H4-EAD.
10) I have done MS in US and worked on F1 OPT then H1B (5th year).

As discussed couple months ago, here is my current situation:

1) 1st I-129 petition for H1B/H4 extension got denied at California service center.
2) 2nd I-129 petition for H1B/H4 extension is pending at Nebraska service center (NSC) for almost three months. However, I submitted this petition with premium processing. When my employer reached out to NSC, they replied that "my petition is under further checks and reviews. NSC doesn't provide time-frame for such reviews."
As per my employer/attorney, my petition has got stuck in security checks which may take months or may be years.
3) My I-140 petition got RFE and employer has replied recently. It may take few more months to get approved.

My queries are:
a) Is it possible to transfer my visa to a new employer knowing that my H1B/H4 visa extension pending with current employer?
b) Should I transfer my visa to a new employer rather than keep waiting for result and consumed 240 days time?
c) Should I wait until my I-140 get approved and then transfer my visa? Not sure by that time I will have project/work.

Please suggest if you have encountered such scenario.

Hi,

My application packet was received by NSC on Sept 22nd, 2016 under premium process.
I did not get response within expected time frame. So, I reached out to them via phone sometime last week of October. The guy over the phone told me that premium process cycle has been stopped for sometime. I asked is it because of the backlogs? He said it could be backlogs or some other reasons. He told me to call back next week.
I called them after a week or so. This time a lady picked up my call and told me she cannot give any info to me. My employer has to contact.
Later on, my employer contacted NSC and got a reply that my case is under further reviews.

I have no clue what this review is all about and whats going on at their end.

However, your case could be different. I still see NSC processing cases after my application received date. Wait for few more days. USCIS sometimes don't update their website frequently and directly send the decision notice. Check with your employer. Your employer can contact NSC for any concerns. Again, that's just my perspective.

Topic: "Case is in transit to an officer for adjudication." meaning..

Hello,

My employer filed I-140 application in a regular processing which reached to Texas Service Center (TSC) on December-22nd-2015 last year. The application is pending since then.

It was converted to premium after 4 months in April-2016. However, TSC could not process the case in premium. When reached out couple times by my employer, TSC replied that my case is under extended review. The premium fees will be returned when decision is made.

Recently, we got an update that "The case is currently in transit to an officer for adjudication."

Can someone please help me what does that mean? How long it will take to get to some decision point? Its already 11 months.
